Charges Withdrawn – Rape – Commonwealth v. C.B.

C.B., who had no prior contacts with the police, was charged with Rape as a felony of the first degree when his wife accused him of forcing himself on her during their separation.

During the preliminary hearing, Ms. Snyder was able to get the accuser to admit that she had exaggerated in her police report and that she was having a hard time emotionally dealing with the pending divorce.

After an investigation and detailed evidence gathering, Ms. Snyder presented the Assistant District Attorney with proof of friendly text messages between husband and wife in the days after the sexual contact; continued communication between the contact and the arrest; and a motion for child support on the same day as the accuser’s request that the police make the arrest.

The Assigned District Attorney confronted the wife/accuser with the preliminary hearing transcripts and our investigation. The District Attorney ultimately withdrew all charges.
